Dementia Training and AL Rules Hearing Delayed

The Board of Health has cancelled the Oct. 18th hearing of the CDPHE proposed rules for AL and dementia care training.

The Department will instead bring their proposed final rules to the Board of Health on Nov. 15th.  in order to comply with changes mandated by the Administrative Procedure Act.

The Dementia Training and Visitation rules, as heard and adopted by the Board of Health on June 21, 2023, did not go into effect as expected in August 2023 due to post-adoption shortcomings related to publication requirements of the state’s Administrative Procedure Act.  Though the rules of implementation did not go into effect, the law was effective October 1st, 2023.  Per the Department’s request for the hearing, “The effective date of the requirement is January 1, 2024, and all staff must be trained no later than 120 days after that date.”
